We are Credit Knowledge Limited, a private company limited by shares having our registered office at 35 Castleknock Drive, Castleknock, Dublin 15 (“Credit Knowledge”, “we”, “us”, “our”). We are company number 524612 registered in the Republic of Ireland. Our services include the provision of credit risk management education and training information and materials for purchase on the website https://creditriskknowledge.ie/ (“the Site”).

 

Please read the following Terms and Conditions carefully. These Terms and Conditions set out the basis upon which you are entitled to access the Site and also outline the legal agreement between you and Credit Knowledge upon so accessing the Site and/or availing of our services available on the Site. 

 

These Terms and Conditions apply to all visitors, users and others who access or use the Site and/or avail of our services available on the Site. By using the Site, you warrant that you have the capacity to contract and you acknowledge your acceptance of these Terms and Conditions and you agree to comply with them in full. 

 

If you do not have the capacity to contract or you do not accept these Terms and Conditions or you do not agree to comply with them in full, you must not use the Site. 

 

Use of the Site 

 

  1. You are permitted to access, view and use the Site for the purposes of browsing and availing of our services. 
  2. In the case of any services available on the Site purchased by you (“paid services”), you are permitted to avail of the paid services when Credit Knowledge is in receipt of payment of the relevant fee due for such services (including any VAT or other tax payable). 
  3. Without our express permission, it is strictly prohibited to:
    1. Reproduce, duplicate, copy, sell, resell or otherwise exploit for any commercial purpose the Site or any portion thereof; 
    2. Use any content and software on the Site in any manner, including reproduction, modification, distribution, transmission, republication or display of the content on the Site. 
  4. You are at all times strictly forbidden to:
    1. misuse the Site by knowingly or recklessly introducing viruses, trojans, worms, logic bombs or other material which is malicious or harmful;
    2. attempt to gain unauthorised access to the Site, the server on which the Site is stored or any server, computer or database connected to the Site; 
    3. attack the Site via a denial-of-service attack or a distributed denial-of-service attack. 
  5. We reserve the right to refuse access to the Site and/or the services available on the Site in our absolute discretion, including, without limitation, if we believe that particular conduct by you is in breach of these Terms and Conditions, harms (or may harm) our interests and/or violates applicable law. 

Intellectual Property 

 

  1. Credit Knowledge grants you a limited, non-transferable, non-exclusive licence to access, view and use the Site and the information and material displayed thereon. In the case of paid services, in consideration of our receipt of your full payment for such services, you will be granted a further limited, non-transferable, non-exclusive licence to access, view and use the paid services purchased only. Such licences are granted subject to the provisions comprised in the remainder of this clause.
  2. All content on the Site, including, but not limited to, text, logos, button icons, graphics, images, audio clips and software on the Site (“Content”) is our property or the property of our suppliers and/or licensors (unless expressly indicated otherwise) and is protected by applicable copyright and/or other intellectual property laws. 
  3. Unless expressly authorised in writing by Credit Knowledge to do so, you are forbidden to modify, copy, reproduce, republish, frame, upload to a third party, post, transmit or distribute the Content in any way. 
  4. Strictly provided that you keep all Content intact and in the same form as presented on the Site (including without limitation all copyright, trademark and other proprietary notices and all advertisements), you are permitted to use an industry-standard Web browser to download and view the Content for your personal, non-commercial use, or, if you are an Internet service and/or access provider, supply the Content to your subscriber.
  5. All trademarks displayed on the Site are trademarks of their respective owners or Credit Knowledge. Without our express permission or that of the third-party owner, nothing contained on the Site should be construed as granting any license or right of use of any trademark displayed on the Site.
  6. You must not use the Site in any manner or for any purpose which is prohibited by these Terms and Conditions, which is unlawful or which violates any right of Credit Knowledge. 
  7. If you wish to request consent for your use of the Content in any way other than that expressly authorised in this clause, please direct a formal request to us by e-mail on creditknowledge1@gmail.com for consideration.

  1. The Site may contain hyperlinks and other pointers to internet websites operated by third parties which not under the control of Credit Knowledge. We are not responsible for the contents of any linked website or any hyperlink contained in a linked website. 
  2. Credit Knowledge will provide these hyperlinks to you for convenience purposes only and the inclusion of any link does not imply any endorsement of the linked website by us.

Linking to the Site 

 

  1. You may link to the homepage of the Site, provided you do so in a way that is fair and legal and does not cause harm to or take advantage of (or have the potential to cause harm to or take advantage of) the goodwill of Credit Knowledge. 
  2. You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where no such association, approval or endorsement exists. 
  3. You must not establish a link to the Site in any website that is not owned by you. 
  4. The Site must not be framed on any other website, nor may you create a link to any part of the Site other than the homepage. 
  5. Credit Knowledge reserves the right to withdraw linking permission without notice in the event of your breach of this clause. 

Limitation of Liability 

 

  1. Credit Knowledge will make every reasonable effort to ensure that the Site is available 24 hours a day, seven days a week. However, electronic services are subject to interruption or breakdown. 
  2. You acknowledge and agree that we may temporarily suspend access to the Site for any reason without notice, including but not limited to where there is a breakdown, error, defect or malfunction of any part of the Site.
  3. You acknowledge and agree that the Site is available for use ‘as is’ and ‘as available’, with no warranties of any kind whatsoever and that, without prejudice to the generality of the foregoing, we make no warranty regarding, and shall have no responsibility for the accuracy, availability, reliability, security, fitness for purpose or performance of the Site or the contents thereof. You use the Site at your own risk.
  4. Except as expressly set out in these Terms and Conditions, all representations, warranties, terms and conditions, whether express or implied, in relation to the Site or the information and material made available to you on the Site and/or as part of our paid services are hereby excluded to the fullest extent permitted by law. 
  5. Whilst the author(s) of all information and material made available to you on the Site and/or as part of our paid services shall use their best endeavours to ensure insofar as possible the accuracy and completeness of that information and material, no responsibility is taken by such author(s) and/or Credit Knowledge for any errors or omissions in such information and material. Nothing within such information and material should be construed as or used as a substitute for appropriate professional advice. 
  6. Due to the fact that we cannot guarantee that the Site will be fault free or that the information and material made available to you on the Site and/or as part of our paid services will be correct, you agree that we shall not be liable for any direct or indirect injury, loss, damage, inconvenience or expense whatsoever or howsoever arising out of or in connection with your use or inability to use the Site or our services available on the Site, whether under theories of contract, tort (including negligence), strict liability or otherwise. 
  7. You expressly acknowledge and agree that Credit Knowledge does not exert control over users of the Site (including individuals referred to on the Site as guests and experts) and is not liable either for their verbal or written statements or their behaviour, including any such statement or behaviour alleged to be defamatory, offensive or otherwise inappropriate, immoral or illegal in nature.
  8. You hereby agree to indemnify Credit Knowledge against any claim, action or proceedings taken by any third party alleging direct or indirect injury, loss, damage, inconvenience and expense caused by your breach of these Terms and Conditions and to further indemnify Credit Knowledge against all damages and costs awarded or agreed to be paid to any third party taking such a claim, action or proceedings. 
  9. Notwithstanding the foregoing provisions of this clause, Credit Knowledge provides an informal complaint procedure for customer service purposes. If you are unhappy with the standard of our services in any way, you are entitled to provide us with details of your complaint by e-mail to creditknowledge1@gmail.com for investigation by us. If we deem your complaint valid, Credit Knowledge will endeavour to resolve the issue(s) subject of your complaint insofar as is possible within a reasonable timeframe, subject at all times to these Terms and Conditions. If we deem your complaint valid and it relates to a paid service purchased by you, Credit Knowledge will endeavour to refund you the fees paid for that paid service within a reasonable timeframe. If we do not deem your complaint valid, no further action shall be required of Credit Knowledge. You agree that these will be the sole and exclusive remedies available through our informal complaint procedure and that nothing in this provision should be construed as restricting, limiting or affecting the operation of any other provision of these Terms and Conditions. 

Registration

 

  1. In order to avail of our paid services, you are required to register as a user of the Site.
  2. By using the Site, you consent to our processing of any data (including any personal data) collected by or provided to us during your registration or availing of our paid services in accordance with our Privacy Policy and our Cookie Policy, together with these Terms and Conditions where applicable. 
  3. By using the Site, you warrant that all data provided by you to Credit Knowledge during your registration or availing of our paid services is accurate.
  4. As part of the registration process, you must choose a personalised Username and Password which will form the log-in details to your personal account on the Site. 
  5. You must take reasonable care to keep the log-in details to your personal account on the Site confidential. 
  6. If you provide a third party with the log-in details to your personal account on the Site, this third party shall become your Nominee and is subject to these Terms and Conditions when accessing, viewing or using the Site or any paid services. 
  7. You are responsible for keeping all records of the log-in details to your personal account on the Site secure and protected from sight or access by any unauthorised third party. Credit Knowledge is not responsible for any direct or indirect injury, loss, damage, inconvenience or expense whatsoever or howsoever arising out of any failure, refusal or neglect on your part in this respect.
  8. Credit Knowledge reserves the right to de-register your personal account for use of the Site in our absolute discretion, including, without limitation, if we believe that particular conduct by you is in breach of these Terms and Conditions, harms (or may harm) our interests and/or violates applicable law.

Payments 

 

  1. Once you have completed the on-site procedure for purchase of a service available on the Site, you will be notified that the purchase has been completed. This transaction creates an electronic contract between you and Credit Knowledge pursuant to which we will be obliged to provide to you the paid services purchased in consideration of payment by you of the relevant fee due to us for those paid services (including any VAT or other tax payable).
  2. In order to purchase any services available on the Site, you are obliged to provide Credit Knowledge with a valid payment method for payment of relevant fees due to us for that/those service/s (including any VAT or other tax payable). In confirming your selected payment method to us, you consent to Credit Knowledge charging your selected payment method for any such fees.
  3. If we cannot charge your selected payment method for any reason (such as expiration or insufficient funds), you remain responsible for any uncollected amounts. We reserve the right to attempt collection of any such uncollected amounts from the same payment method or any new payment method subsequently provided by you to Credit Knowledge. We further reserve our right to engage debt collection and/or legal agents if we deem such engagement to be necessary.
  4. You agree that Credit Knowledge is not responsible for any failure, refusal or neglect on the part of your selected payment method provider(s) in or connected with the processing of any payment to us. You further agree that Credit Knowledge is not liable for any direct or indirect injury, loss, damage, inconvenience or expense whatsoever or howsoever arising from such failure, refusal or neglect on the part of your selected payment method provider(s). 
  5. You agree that you are liable for all transactions carried out on the Site by you or by anyone carrying out a transaction with your authority or express or implied consent, regardless of when the transaction is processed to your account. 
  6. Once Credit Knowledge is in receipt of payment of the relevant fee due for paid services purchased by you (including any VAT or other tax payable), that payment is non-refundable. 
  7. Credit Knowledge reserves the right to alter the specifications of any service available on the Site at any time in our absolute discretion, including, but not limited to, its price, content and/or availability, and you agree that you are not entitled to any price protection, refund or replacement from us in the event of any such alteration.
  8. You should check your statements and records carefully. If you believe an issue has arisen with a transaction or an unauthorised transaction has taken place, please contact us immediately by e-mail on creditknowledge1@gmail.com

Variations 

 

  1. Credit Knowledge reserves the right to amend the Terms and Conditions at any time. Since you are bound by these Terms and Conditions, you should periodically refer to them. 
  2. The Terms and Conditions will be accessible on the Site.
  3. The latest date on which the Terms and Conditions have been amended by us will be displayed on the Site. 

Other Applicable Terms 

 

  1. These Terms and Conditions refer to the following additional terms, which also apply to your use of the Site and our services: 
    1. Our Privacy Policy, which outlines the terms upon which any personal data we collect from you, or that you provide to us, is processed. By using the Site, you consent to such processing and you warrant that all data provided by you is accurate. 
    2. Our Cookies Policy, which provides information about the cookies on the Site.
  2. These Terms and Conditions, together with our Privacy Policy and our Cookie Policy, form the entire agreement between you and Credit Knowledge and this agreement supersedes any prior agreements and arrangements between us, whether written or oral. 
  3. You confirm that you have not relied on any representations in entering into this agreement with us. 
  4. Credit Knowledge may assign, transfer or sub-contract any of our rights or obligations pursuant to this agreement to any third party at our absolute discretion.
  5. This agreement will be governed by and construed in accordance with the laws of the Republic of Ireland and you hereby submit to the exclusive jurisdiction of the Courts of the Republic of Ireland.
  6. If any provision of this agreement is found to be invalid or unenforceable by a court of law, such invalidity or unenforceability will not affect the remainder of this agreement, which will continue in full force and effect.
